Terms of Service
These Terms of Service (hereinafter referred to as "these Terms") set forth the terms and conditions for the use of i-TanQ (hereinafter referred to as "the Service"). All users (hereinafter referred to as "Users") of the Service must agree to these Terms before using the Service.
Article 1 (Application)
These Terms shall apply to all relationships between the User and the operator of the Service (hereinafter referred to as "the Operator") regarding the use of the Service.
Article 2 (Registration)
This service is available only to persons 13 years of age or older. Persons under 13 years of age may not use this service, even with parental consent.
- The registration for the Service shall be completed when a prospective user agrees to these Terms, applies for registration in the manner prescribed by the Operator, and the Operator approves the application.
- The Operator may not approve an application for registration if it determines that the applicant has any of the following reasons, and shall not be obligated to disclose the reasons therefor.
- If the applicant is under 13 years of age
- When false information is provided in the application for registration
- When the application is from a person who has violated these Terms
- In any other case where the Operator deems the registration to be inappropriate
Article 3 (Management of User ID and Password)
- The User shall, at his/her own responsibility, properly manage his/her user ID and password for the Service.
- The User may not, under any circumstances, transfer or lend his/her user ID and password to a third party, or share them with a third party. The Operator shall assume that the Service is used by the User who is registered as the owner of the user ID if the combination of the user ID and password matches the registered information.
- The Operator shall not be liable for any damage caused by the use of a user ID and password by a third party, except in cases of willful misconduct or gross negligence on the part of the Operator.
Article 4 (Handling of Learning Logs)
- The User agrees that learning logs (including, but not limited to, learning time, comments, and event history) generated through the use of the Service will be used by the school to which the User belongs and by the Operator for the purpose of improving the quality of the Service and developing AI learning coaches for each school.
- For the purpose of the preceding paragraph, the Operator may statistically process and analyze learning logs and provide them to third parties in a form that does not identify individuals.
- The Operator shall respect the privacy of Users and shall exercise the utmost care in protecting personal information.
Article 5 (Prohibited Matters)
In using the Service, the User shall not engage in any of the following acts:
- Acts that violate laws and regulations or public order and morals
- Acts related to criminal acts
- Acts that infringe on the copyrights, trademark rights, or other intellectual property rights included in the Service, such as the contents of the Service
- Acts that destroy or interfere with the functions of the servers or networks of the Operator, other Users, or other third parties
- Acts that may interfere with the operation of the Service
- Unauthorized access or attempts to do so
- Acts of collecting or accumulating personal information, etc. of other Users
- Acts of impersonating other Users
- Acts of directly or indirectly providing benefits to antisocial forces in connection with the Service
- Any other acts that the Operator deems inappropriate
Article 6 (Suspension of the Service, etc.)
- The Operator may suspend or discontinue all or part of the Service without prior notice to the User if it determines that any of the following events has occurred.
- When performing maintenance inspections or updating the computer system for the Service
- When it becomes difficult to provide the Service due to force majeure such as earthquake, lightning, fire, power outage, or natural disaster
- When the computer or communication lines, etc. stop due to an accident
- In any other case where the Operator deems it difficult to provide the Service
- The Operator shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Service.
Article 7 (Restriction of Use and Cancellation of Registration)
- The Operator may, without prior notice, restrict the use of all or part of the Service by a User or cancel the registration of a User if the User falls under any of the following categories.
- In case of violation of any of the provisions of these Terms
- When it is found that there is a false fact in the registered matters
- In any other case where the Operator deems the use of the Service to be inappropriate
- The Operator shall not be liable for any damage caused to the User by the actions taken by the Operator pursuant to this Article.
Article 8 (Disclaimer of Warranty and Disclaimer of Liability)
- The Operator does not explicitly or implicitly guarantee that the Service is free from factual or legal defects (including defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors, bugs, infringements of rights, etc.).
- The Operator shall not be liable for any and all damages incurred by the User arising from the Service. However, this disclaimer does not apply if the contract between the Operator and the User regarding the Service (including these Terms) is a consumer contract as defined in the Consumer Contract Act.
Article 9 (Changes to the Service Content, etc.)
The Operator may change the content of the Service or discontinue the provision of the Service without notice to the User, and shall not be liable for any damage caused to the User as a result thereof.
Article 10 (Changes to the Terms of Service)
The Operator may, at its own convenience, change these Terms at any time without notice to the User. If the User starts using the Service after the change of these Terms, the User shall be deemed to have agreed to the changed Terms.
Article 11 (Governing Law and Jurisdiction)
- The interpretation of these Terms shall be governed by the laws of Japan.
- In the event of a dispute regarding the Service, the court having jurisdiction over the location of the head office of the Operator shall have exclusive jurisdiction.
